What Is Deadly Force?

Deadly force. It’s a term you hear in movies and cop dramas that means exactly what it sounds like. The definition of ‘deadly force’ as used by the Armed Forces of the United States is the use of force to cause another person injury or death where the use of force cannot be justified unless under ‘extreme necessity a last resort’ or when all other means of escape have been exhausted or simply cannot be used. Using weapons, vehicles, and even explosives to harm another person can be considered using deadly force.

The only people that are granted the right to use deadly force are police and military personnel, and that is only if there is no question that someone is in danger or that someone is a danger to everyone around them. Police and military personnel have the right to use deadly force if they have plausible reason to think that the attackers are a threat and there is no other way to apprehend them, such as through negotiation. A good example of this type of situation is a gunman in a shopping mall who opens fire on the innocents there. In this situation the police would be well in their rights to use deadly force.

Civilians in America can use deadly force legally if their life or the lives of their family or anyone around them is in ‘legitimate and imminent danger’. In other words, in self-defense. But any civilian who is willing to use deadly force to protect themselves and others should also be willing to have their actions scrutinized by the justice system to see if the actions were deemed necessary and if any other legal action would need to be pursued against that person. If you cannot prove that your life or the life of others was in danger at the time you used deadly force you could be convicted of homicide and sent to jail.
